Over the past few years, we have observed more vigorous legislative activity in the EU energy sector in response to the energy crisis and the acceleration of the energy transition.

These new developments bring not only new opportunities but also new regulatory challenges that make an adequate assessment and review necessary. If you wonder, as a NRA legal expert or even non-lawer, what the possible consequences might be for NRAs and their regulatory practice, then this CEER Training will provide you with an update on a selection of European energy regulatory developments and an overview of relevant European Court’s energy cases.

Course Context

European energy market is well-known for its speedy development. The temp is being driven by ongoing legislative process, which delivers several new or amended legal acts on a yearly basis.
   
This CEER Legal & Policy Training will provide participants with an update on a selection of the European energy regulatory developments with a specific focus on grid expansion & investment.  Participants will also get insights of CEER's point of view about EU proposals.  

A specific session is dedicated to Network codes & Enforcement which is  crucial in order to guarantee a timely implementation and an effective functioning of the internal energy market.
ACER keeps on adopting numerous generally binding decisions both on regional and EU level. The supervision of the implementation of those decision lays within the competence of the NRAs. An effective enforcement is crucial in order to guarantee a timely implementation and an effective functioning of the internal energy market. One of the sessions will present the current status of discussions regarding potential improvements to the monitoring and enforcement framework.

The course also focuses on cases study concerning DSOs in integrating new data challenges as well as on the judicial review process conducted by the ACER Board of Appeal (BoA) and the European Courts (EGC/ECJ) and  concerning ACER’s decisions. An NRA's Representative will also present about the BoA & EGC procedures from NRA’s perspective. 

The course will conclude with a guided tour of the European Court of Justice.

ALEXANDER LINOV

Alexander Linov is a Senior Legal Advisor at the Federal Network Agency (Bundesnetzagentur) where he has gained professional experience in various legal areas of gas and electricity market regulation including interpretation and implementation of network codes/guidelines, TSO unbundling, infrastructure, environmental law, REMIT, governance and international issues. Alexander is vice-chair of CEER Legal Affairs Committee (LAC), being responsible for several CEER publications and an active member of ACER's Legal Expert Network (LEN). Alexander holds a Master of Law (Magister iuris) degree from the University of Cologne and has been admitted to the German Bar.

COURSE ADVISOR

ADRIEN DE HAUTECLOCQUE 

Dr Adrien de Hauteclocque is the Head of Cabinet of the President of the General Court of the European Union and a Principal Adviser of the Florence School of Regulation (European University Institute). He is also an invited professor at HEC Paris. From January 2023 he is also a Part-time Professor at the Florence School of Regulation (FSR). His research interests include EU competition and state aid law, competition policy in network industries and the law & economics of energy regulation. He is a regular speaker at international conferences and has published numerous books, academic articles and book chapters in the last ten years. Dr de Hauteclocque obtained his PhD in Law from the University of Manchester (UK) and holds a MSc in Management from EM Lyon (France) and a MSc in Economic Policy from Strathclyde University (UK).
